Please read them carefully as they affect your rights and

By accepting these Terms of Use through your use of the
Site, you certify that you are 18 years of age or older. If

Tenseseconds.com does not intentionally collect personal
information about children under the age of 13. Children

legal guardians may not agree to these Terms of Use on their
behalf. If you are a parent or legal guardian agreeing to
these Terms of Use for the benefit of a child between the
ages of 13 and 18, be advised that you are fully responsible
for his or her use of this Site, including all financial
charges and legal liability that he or she may incur. If you
do not agree to (or cannot comply with) any of these terms
and conditions, do not use this Site. All billing and
registration information provided must be truthful and
accurate. Providing any untruthful or inaccurate information
may constitute a breach of these Terms of Use. By confirming
your purchase at the end of the checkout process, you agree
to accept and pay for the item(s) requested.
Objectionable Material. You understand that by using this
Site or any services provided on the Site, you may encounter
Content that may be deemed by some to be offensive,
indecent, or objectionable, which Content may or may not be
identified as such. You agree to use the Site and any
service at your sole risk and that Tenseseconds.com and its
affiliates shall have no liability to you for Content that
may be deemed offensive, indecent, or objectionable.

Membership Eligibility
Our services are available only to, and may only be used by
individuals who can form legally binding contracts under
applicable law. Without limiting the foregoing, our services

only in conjunction with, and under the supervision of your
parents or guardians. If you do not qualify, please do not
use our Site. Further, your tenseseconds account (including
feedback) and User ID may not be transferred or sold to
another party.

and any changes will be notified to you via the e-mail
address provided by you on registration or via a suitable
announcement on the Tenseseconds.com Site. The changes will
apply to the use of the Tenseseconds.com Site after we have
given notice. If you do not wish to accept the new Terms and
Conditions you should not continue to use the
Tenseseconds.com Site and the Online Stores. If you continue
to use the Tenseseconds.com Site after the date on which the
change comes into effect, your use of the Tenseseconds.com
Site indicates your agreement to be bound by the new Terms
and Conditions.

Termination
These Terms are effective until terminated by Tenseseconds.
TENSESECONDS may terminate these Terms without notice and at
any time. In the event of termination, you are no longer
authorized to access the TENSESECONDS.com Site, and the
restrictions imposed on you with respect to the Content, and
the disclaimers, indemnities, and limitations of liabilities
set forth in these Terms shall survive termination.
TENSESECONDS shall also have the right without notice and at
any time to terminate the TENSESECONDS.com Site or any
portion thereof, or any products or services offered through
the TENSESECONDS.com Site, or to terminate any individual's
right to access or use the TENSESECONDS.com Site or any
portion thereof.
6.
e-Communications
When you visit Tenseseconds.com or send e-mails to us, you
are communicating with us electronically. You consent to
receive communications from us electronically. We will
communicate with you by e-mail or by posting notices on this
site. You agree that all agreements, notices, disclosures
and other communications that we provide to you
electronically satisfy any legal requirement that such
communications be in writing.
7. Site Security
Users are prohibited from violating or attempting to violate
the security of the Site, including, without limitation, (a)
accessing data not intended for such user or logging onto a
server or an account which the user is not authorized to
access; (b) attempting to probe, scan or test the
vulnerability of a system or network or to breach security
or authentication measures without proper authorization; (c)
attempting to interfere with service to any user, host or
network, including, without limitation, via means of
submitting a virus to the Site, overloading, "flooding,"
"spamming," "mailbombing" or "crashing;" (d) sending
unsolicited email, including promotions and/or advertising
of products or services; or (e) forging any TCP/IP packet

newsgroup posting. Tenseseconds.com will investigate
occurrences that may involve such violations and may
involve, and cooperate with, law enforcement authorities in
prosecuting users who are involved in such violations. You
agree not to use any device, software or routine to
interfere or attempt to interfere with the proper working of
this Site or any activity being conducted on this Site.
8. Indemnity
You agree to indemnify and hold us and (as applicable) our
parent, subsidiaries, affiliates, officers, directors,
agents, and employees, harmless from any claim or demand,
including reasonable attorneys' fees, made by any third
party due to or arising out of your breach of this Agreement
or the documents it incorporates by reference, or your
violation of any law or the rights of a third party.
You agree to defend, indemnify and hold harmless
tenseseconds.com and its affiliates from and against any and
all claims, damages, costs and expenses, including
attorneys' fees, arising from or related to your use of the
Site.
9.
Your Account
If you use this site, you are responsible for maintaining
the confidentiality of your account and password and for
restricting access to your computer, and you agree to accept
responsibility for all activities that occur under your
account or password. Tenseseconds.com does sell products for
children, but it sells them to adults, who can purchase with
a credit card. If you are under 18, you may use
Tenseseconds.com only with involvement of a parent or
guardian. Tenseseconds.com and its affiliates reserve the
right to refuse service, terminate accounts, remove or edit
content, or cancel orders in their sole discretion.
10. Intellectual
property
The content of the Tenseseconds.com Site is protected by
copyright, trade marks, database and other intellectual
property rights. You may retrieve and display the content of

companies including, without limitation, the trade marks
TENSESECONDS and TENSESECONDS.COM.

Excluded Services
The services provided by the Tenseseconds.com Site do not
include the provision of computer or other necessary
equipment to access the Tenseseconds.com Site. To use the
Tenseseconds.com site you will require Internet connectivity
and appropriate telecommunication links. We shall not be
liable for any telephone or other costs that you may incur.

Submissions
Except as otherwise expressly provided herein or in the
TENSESECONDS PRIVACY POLICY posted on the TENSESECONDS.com
Site, any communication or material you transmit to the
TENSESECONDS.com Site by electronic mail or otherwise,
including any questions, comments, suggestions, or the like,
is and will be treated as non-confidential and
non-proprietary and may be used by TENSESECONDS,
TENSESECONDS vendors, or their affiliates or related
entities for any purpose, including but not limited to
reproduction, disclosure, transmission, publication,
broadcast, and posting. Furthermore, TENSESECONDS,
TENSESECONDS vendors, and their affiliates and related
entities are free to use any ideas, concepts, know-how, or
techniques contained in any communication you send to the
TENSESECONDS.com Site for any purpose whatsoever, including,
but not limited to, developing, manufacturing, and marketing
products or services using information contained in such

Reviews, Comments, Communications, and Other Contents

the content is not illegal, obscene, threatening,

indicate otherwise, you grant Tenseseconds.com and its

Tenseseconds.com and its affiliates and sublicensees the

and will not cause injury to any person or entity; and that
you will indemnify Tenseseconds.com or its affiliates for

Tenseseconds.com has the right but not the obligation to

Tenseseconds.com takes no responsibility and assumes no
liability for any content posted by you or any third party.

Limitations

and expenses reasonably suffered or incurred by us, all
damages awarded against us under any judgment by a court of
competent jurisdiction and all settlements sums paid by us
as a result of any settlement agreed by us arising out or in

with respect to the subject matter hereof, and supersede all
previous written or oral agreements between the parties with
respect to such subject matter. No waiver by TENSESECONDS of
any breach or default hereunder shall be deemed to be a
waiver of any preceding or subsequent breach or default. If
any provision of these Terms shall be unlawful, void, or for
any reason unenforceable, then that provision shall be
deemed severable from the Terms and shall not affect the
validity and enforceability of any other provisions of the
Terms. The headings and captions in these Terms are intended
for convenience only and shall in no way affect the
interpretation of the Terms.
TENSESECONDS shall not be liable for any nonperformance or
delay in performance caused by any act beyond its reasonable
control, including but not limited to acts or omissions of
third parties, unavailability of supplies, equipment
failure, war, strikes, lock-outs, fire, flood, or any other
Act of God, any law, regulation, ordinance, or other act or
order of any court, government, or governmental agency, or
delays, unavailability, errors, or other failures of the
Internet or other data networks.
